Customers are responsible for travel costs exceeding $1,000 for on-site service.
All applicable manufacturer warranties will be passed through where permitted.
Custom kits are built according to customer-provided specifications. AquaPhoenix warrants only conformity to those specifications and makes no guarantees regarding safety or fitness for use.
All products are intended for industrial, educational, and laboratory use only. They are not intended for food, drug, or household applications.
The customer assumes full responsibility for:
The customer agrees to indemnify and hold AquaPhoenix harmless from any claims, damages, or liabilities resulting from misuse, negligence, or unlawful use of products.
Customers are responsible for return shipping unless the return is due to an AquaPhoenix error.

NEITHER PARTY SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR BUSINESS INTERRUPTION, REGARDLESS OF THE LEGAL THEORY UNDER WHICH SUCH DAMAGES ARE CLAIMED.
